Terms of Use

Owner/Operator: IEPLearning (“IEPLearning,” “we,” “our,” or “us”)

By accessing or using ieplearning.com and any related forums, content, or services (the “Service”), you agree to these Terms of Use (the “Terms”). If you don’t agree, do not use the Service.

1) Who may use the Service

You must be at least 13 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent you’re authorized to bind that organization and these Terms apply to it.

2) Accounts & security

You’re responsible for your account, your credentials, and all activity under it. Keep your password confidential and notify us promptly of any unauthorized use.

3) Community rules & user content

You are responsible for content you post (“User Content”). Do not post illegal, harassing, defamatory, pornographic, hateful, spam, malware, or otherwise harmful material; doxx individuals; or violate others’ rights (privacy, copyright, trademark, etc.).

You grant IEPLearning a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, display, and create derivative works from your User Content solely to operate, improve, and promote the Service. You retain ownership of your User Content.

We may (but have no obligation to) monitor, moderate, edit, or remove User Content or suspend accounts at our discretion for any reason, including violations of these Terms.

If you believe content infringes your copyright, email legal@ieplearning.com with: (1) your contact info; (2) identification of the work; (3) the infringing URL; (4) a statement under penalty of perjury; and (5) your signature.

4) No legal or medical advice

Information on the Service (including forum posts) is for educational and general information only and does not constitute legal, medical, or professional advice. Consult a qualified professional about your specific situation. Your use of the Service is at your own risk.

5) Section 230 (47 U.S.C. § 230) notice

IEPLearning is an interactive computer service. Users—not IEPLearning—are solely responsible for their own posts and content. Consistent with Section 230, IEPLearning is not liable for third-party content and may, in good faith, restrict or remove content we consider objectionable, whether or not such material is constitutionally protected.

6) Third-party links & services

We may link to third-party sites/services we don’t control. We aren’t responsible for their content, policies, or practices.

7) Privacy

Your use is also governed by our Privacy Policy. By using the Service, you consent to our data practices described there.

8) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, IEPLearning DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that information will be accurate, complete, or current.

9) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IEPLearning AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED $100 IN THE AGGREGATE.

10) Indemnification

You agree to defend, indemnify, and hold harmless IEPLearning and our affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

11) Binding arbitration; class-action waiver; Nebraska law

Please read this section carefully—it affects your rights.

  • Agreement to Arbitrate. Any dispute, claim, or controversy of any kind arising out of or relating to these Terms or the Service (collectively, “Disputes”) will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or Consumer Rules, if applicable), before a single arbitrator.
  • Federal Arbitration Act. This arbitration agreement is governed by the Federal Arbitration Act (FAA) and applies to all Disputes, to the broadest extent permitted by law.
  • Venue & Governing Law. The seat and venue of arbitration is Douglas County, Nebraska, unless the parties agree otherwise. Nebraska law (without regard to conflicts of law) governs these Terms and the Service, except to the extent preempted by the FAA.
  • Class/Collective Actions Waiver. Arbitration will be conducted only on an individual basis. No class, collective, consolidated, or representative actions are permitted. The arbitrator may award relief only to the individual party to the extent necessary to resolve that party’s claim.
  • Small-claims carve-out. Either party may bring an individual action in Nebraska small-claims court instead of arbitration.
  • Injunctive relief for misuse. IEPLearning may seek temporary or preliminary injunctive relief in a court of competent jurisdiction in Nebraska to protect the Service, IP, or data security while arbitration is pending.
  • Costs. Filing, administration, and arbitrator fees will be governed by AAA rules. The arbitrator may award fees/costs to the prevailing party where permitted by law.
  • 30-day opt-out. You may opt out of this arbitration agreement by emailing legal@ieplearning.com within 30 days of first accepting these Terms, stating your full name, the email tied to your account, and that you wish to opt out. Opt-out does not affect other provisions of these Terms.

By accepting these Terms, you and IEPLearning waive the right to a jury trial and to participate in a class action.

12) Intellectual property

The Service (text, graphics, logos, software, etc.) is owned by or licensed to IEPLearning and protected by IP laws. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works from the Service.

13) Termination

We may suspend or terminate the Service or your access at any time, with or without notice. You may stop using the Service at any time. Sections that by their nature should survive (e.g., licenses, disclaimers, limitations, arbitration) survive termination.

14) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll post the revised Terms with a new effective date. Your continued use after changes means you accept the revised Terms.
